These Terms of Use (“Terms”) constitute a legally binding agreement between you (“you” or “user”) and Autograph Yacht Group (“Autograph Yacht Group,” “we,” “our,” or “us”) governing your access to and use of www.autographyachts.com (the “Site”), including any associated content, features, or services.

1. Changes to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Site following the posting of changes constitutes your acceptance of such changes. You are responsible for reviewing the Terms regularly.

2. Eligibility

By using this Site, you affirm that you are at least 18 years of age or the age of majority in your jurisdiction, and legally able to enter into these Terms. If you are under 18, you may use the Site only under the supervision of a parent or legal guardian.

3. Site Purpose and Limitations

This Site is intended for informational purposes only. While we strive for accuracy, product listings, pricing, and specifications may vary and are subject to change without notice. All transactions are subject to final approval, availability, and separate agreement.

The Site displays third-party listings retrieved via API from BoatWizard, a Boats Group company. We do not guarantee the accuracy or availability of these third-party listings.

Autograph Yacht Group operates in the United States and does not represent that the Site is appropriate or available for use in other jurisdictions. Users accessing the Site from outside the U.S. do so at their own risk and are responsible for complying with applicable laws.

4. Intellectual Property Rights

All content on this Site, including but not limited to text, logos, graphics, videos, photos, software, and trademarks (“Content”), is owned or licensed by Autograph Yacht Group and is protected under U.S. and international intellectual property laws.

Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non-transferable license to view and use the Site and its Content for your personal, non-commercial use. No Content may be copied, modified, distributed, reproduced, republished, uploaded, posted, or transmitted in any form without prior written consent. This includes all images, boat listings, videos, and text. Unauthorized scraping or rehosting of any site content is strictly prohibited.

5. User Conduct and Prohibited Activities

You agree not to:

• Use the Site in any unlawful, fraudulent, or harmful way

• Violate any applicable local, state, national, or international law

• Attempt unauthorized access to any portion of the Site or its systems

• Transmit viruses, malware, or other harmful code

• Scrape, crawl, or use bots to collect data from the Site without written permission

• Impersonate any person or entity

• Submit false, misleading, or offensive information via forms, listings, or communications

We reserve the right to suspend or permanently ban users who violate these Terms.

6. User Submissions

If you submit reviews, listings, contact forms, or other content, you grant Autograph Yacht Group a non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable right to use, reproduce, adapt, publish, translate, and display such submissions worldwide in any media.

• Your content does not infringe on any third-party rights

• Your content is not false, misleading, defamatory, or unlawful

7. Third-Party Sites and Services

This Site may contain links to third-party websites. Autograph Yacht Group does not control or endorse these third-party sites and is not responsible for their content, policies, or practices. Visiting any third-party site is at your own risk.

8. Advertising and Paid Media

We run paid advertisements, including but not limited to Google Ads, Facebook Ads, retargeting campaigns, and other paid placements. We do not guarantee results, availability, or performance of any advertising shown through the Site.

9. Live Chat and External Tools

The Site utilizes a third-party live chat tool provided by Ruby. Your use of live chat constitutes consent to the collection and transmission of data in accordance with our Privacy Policy and Ruby’s data practices.

10. AI Inquiry Management

This SMS campaign may respond to our leads who are interested in our services. You will receive a series of questions to qualify you prior to scheduling an appointment.

You can cancel the SMS service at any time. Simply text “STOP” to the shortcode. Upon sending “STOP,” we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

If you experience issues with the messaging program, reply with the keyword HELP for more assistance, or reach out directly to info@autographyachts.com.

Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.

11. Disclaimers

The Site and its Content are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied. We do not guarantee that the Site will be error-free or uninterrupted, or that any content is accurate, complete, or current.

We expressly disclaim any and all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. All boat specifications, photos, and pricing are subject to change without notice and may vary by location or availability.

12. Limitation of Liability

To the fullest extent permitted by law, Autograph Yacht Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the Site. Our total liability shall not exceed one hundred dollars ($100).

13. Indemnification

You agree to indemnify and hold harmless Autograph Yacht Group, its affiliates, employees, officers, agents, and contractors from any claims, liabilities, damages, losses, or expenses (including attorney’s fees) arising out of or in connection with your use of the Site, your submissions, or your violation of these Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by the laws of a state of our choosing, without regard to conflict of law principles. Any disputes shall be brought in the state or federal courts located in that state.
